Regitup provides a trademark search function that helps users conduct a preliminary assessment of potential trademark conflicts and evaluate the feasibility of filing an application.
Access the Trademark Search Page
You can access the Trademark Search page by selecting Services > Trademark Search from the website's top navigation menu.
Alternatively, you may start a search directly from the quick search bar located at the top of the homepage.
Step 1: Select a Jurisdiction
Choose the jurisdiction where you intend to apply for trademark protection:
Hong Kong
Mainland China
Taiwan
💡 Currently, each search only supports one jurisdiction at a time.
Step 2: Select Classes for Goods / Services
Trademark registration worldwide follows the Nice Classification, an international classification system established by the World Intellectual Property Organization (WIPO). The system consists of 45 classes, which define the scope of protection for different goods and services.
Please select the classes that are relevant to your existing or planned business activities.
For example:
Clothing Retail : Class 18, Class 25
Cosmetics : Class 3, Class 35
Beauty Services : Class 44
Restaurant and Catering Services : Class 29, Class 30, Class 35, Class 43
How Many Classes Should I Select?
Regitup recommends prioritizing the classes most relevant to your business and selecting no more than five classes per search to obtain more focused and meaningful results.
💡 Selecting too many classes may generate a large number of similar trademark results, which may reduce the accuracy and relevance of the analysis.
Although a trademark application may cover multiple classes, selecting excessive classes does not necessarily provide broader protection. Instead, it may:
Increase the likelihood of encountering similar trademarks
Raise the potential risk of refusal
If you are unsure which classes to choose, you may refer to the Nice Classification Guide or use the platform's industry search function for assistance.
Step 3: Enter the Trademark Name
Enter the trademark name you wish to search and click the search icon to view the results instantly.
💡 To improve the likelihood of successful registration, please note the following restrictions:
✘ Do not include geographical names (e.g. "Hong Kong", "China", "USA")
✘ Do not use purely descriptive adjectives (e.g. "Excellent", "Fast", "Premium")
✘ Do not include industry-related terms (e.g. "Technology", "Food", "Fashion")
✘ Do not use offensive, inappropriate, or negative expressions
Step 4: Review the Search Results
Risk Level
The system provides a preliminary risk assessment based on similar trademark registrations. Click the risk level to view the corresponding analysis.
Low Risk : Few or no similar trademarks identified. Registration is generally more likely to succeed.
Medium Risk : Some similarities exist and further assessment is recommended.
High Risk : Highly similar trademarks have been identified, resulting in a higher risk of refusal.
⚠️ Risk levels are provided for reference only. Actual examination outcomes may vary depending on the relevant trademark office's assessment criteria.
Trademark Similarity Score
The system displays a similarity score ranging from 0% to 99%. Lower scores indicate lower similarity while higher scores indicate higher similarity.
For example:
0% = No obvious similar trademarks found
99% = Highly similar trademarks found and a refusal is highly likely
The similarity assessment is based primarily on the following factors:
Visual Similarity
Trademarks may be considered similar if their appearance, character structure, arrangement, typography, or overall visual impression is alike, even when the wording is not identical.
Examples : Emilie / Emilia;太雄餅家 / 大雄餅店
Phonetic Similarity
Trademarks with identical or similar pronunciation may cause confusion during verbal communication, advertising, or customer referrals.
Examples : Emilie / Emily、樂悠悠 / 樂柔柔
Conceptual Similarity
Trademarks may be regarded as similar if they convey a comparable meaning, concept, association, or brand impression, even if the words or designs differ.
例如:愛星星 / Love⭐、寵物在線 / Pet Online
⚠️ Similarity scores are provided for reference only. Actual examination outcomes may vary depending on the relevant trademark office's assessment criteria.
